API Terms of Use

ePrice Oy (“ePrice”) owns the online marketplace platform www.huuto.net (“Site”). By using or developing on the Huuto.net Application programming interface platform (“API”), you agree to be bound by these API Terms of Use (the “Terms”).

To make use of the Site easier, ePrice makes API available to developers to create applications for the Site.

These Terms govern use of API unless you have another agreement in place separately with ePrice on the use of API.

Use of API does not at the moment require registration with ePrice as a developer.

1. Use of API

You may use API to develop an Application designed to help the Site’s users or enhance the Site’s user experience (“Application”).

You may not use API or your Application for marketing, selling or otherwise commercially. Your Application must be freely accessible to its user (“End user”) without a separate charge.

You may not use any content or data from the Site or accessed via the API (“Content”) for advertising, promotions or mass messaging. Content must not be distributed to anyone else than your Application’s users. Content or access to Content must not be in any way directly or indirectly shared, sold or sublicensed to anybody. Content may not be aggregated or combined with other data in such a way that an End user cannot attribute it to the Site.

You or your Application may not in any way scrape, transmit or reproduce (including using any kind of automatic system such as ”robot-”, ”spider-”, ”scraper-” and ”offline reader-” software) the Site or any part of it. You or your Application may not request more Content than is necessary for your Application to function or than is otherwise permitted by these Terms. Content, the Site, API or any part of them may not be copied, reverse-engineered or modified. You or your Application may not disrupt any of the Site’s services or systems. You may not use API if your Application makes an excessive amount of API calls. Each End user /application must authenticate individually to retrieve his or her content through the API.

2. Rights of Users

Your Application may not include inappropriate or unlawful material or harm or inappropriately discriminate the Site’s users or your End users.

Your Application must include its own user terms and privacy policy that meet all applicable legal standards.

Your End users must be aware of what information your Application collects and how it’s used. You have to get End users’ consent by telling them what information you collect and how you use, store or share it prior to obtaining information from them.

You must promptly notify ePrice of any breaches of your user agreement or privacy policy that impact or may impact the Site’s users.

You or your Application may not complicate or hide any of the Site’s functions from your End users. If your End users access the Site’s user-specific Content through the API, they must sign-in with their user name and password for the Site (“Login credentials”) and grant your Application access to their user-specific Content. You may not intercept or store the Login credentials. You or your application may not use Login credentials or any tokens that have been provided to you to show user-specific Content of a Site’s user to anyone else than that user.

Other Obligations

You, your Application and End Users of your Application must also comply with the following:

  1. The Site’s User Agreement;

  2. The Site’s Privacy Policy;

If there is any conflict between these Terms and the above documents, these Terms control your use of the API.

3. Storage and exportation of Content

You or your Application may not store or export Content for the purpose of service duplication, reverse-engineering or for any other reason not specifically mentioned in these Terms.

Tokens

You may store any tokens provided to you in connection with the use of API (“Tokens”).

Caching Content for Performance reasons

You may cache Content for up to 24 hours from a request for that Content through the API after which the cached Content must be deleted.

You may cache the Content only for performance reasons to improve the user experience of your Application.

Profile Data

“Profile data” means Content relating to a Site’s user including contact information and information about sales and purchases of the user. Profile data of a Site’s user does not include identifiable information about any other Site’s user.

You may store or export Profile data of the Site’s user only if you have the consent of the Site’s user to do so and the Site’s user has requested it. You must store Profile Data only for the benefit of the Site’s user that has granted you access to it and a permission to store it. Stored or exported Profile data must be immediately destroyed to the extent it contains identifiable information, such as user names, about any other Site’s user than the one who has requested the Profile Data.

You may update the Site’s user’s Profile Data that you have stored, only when the user using your Application requests it.

ePrice is in no way responsible for the user’s Profile data or its subsequent use after it has been exported or stored.

Deletion of the Content

Content collected with the Site’s user’s consent, including Tokens, must be deleted promptly after that Site’s user requests it, uninstalls your Application or closes his or her account with the Site.

All Content must be deleted if your use of the API is terminated, except when doing so would cause you to violate any law, regulation or any obligation set by a government agency.

4. Safety and Abuse

Your network, operating system and the software of your web servers, databases, and computer systems (collectively, “Systems”) must be appropriately configured to securely run your Application and store Content.

Your Application must use reasonable security measures to protect the information of your End users. You may not design or select your Systems in a manner to avoid these obligations.

You must report any security deficiencies in or intrusions to, your systems that you discover to ePrice in writing via email to webmaster@huuto.net and work with ePrice to correct any security deficiency and will immediately disconnect any intrusions or intruder when required by ePrice. In the event of any security deficiency or intrusion involving the Application, API or Content, you may not make any public statements (e.g. press, blogs, social media, bulletin boards, etc.) without a prior written and explicit consent of ePrice.

5. ePrice Property

ePrice owns all rights, including all intellectual property rights, in and to, the Site, API and all elements, components, and executables of the API; Content (“Property”) Content which you as the Site’s user have licensed or assigned to the Site under the User Agreement is not governed by these API Terms of use. ePrice has no rights or control over your Application to the extent it does not contain ePrice’s Property.

Any rights not expressly granted are withheld.

You may submit suggestions or other feedback regarding ePrice’s services. By submitting suggestions or feedback you acknowledge that ePrice is not bound by any confidentiality obligations with respect to them. ePrice may also choose to use or disclose your suggestions or feedback in any way and for any purpose. Additionally you agree that by submitting suggestions or feedback you are not entitled to any compensation of any kind from ePrice.

Site as the source of the Content

Site must always be mentioned as the source of the Content. You may not use Property or the Site’s brand to promote your Application.

You may not display the Site or ePrice in any way that is misleading, offensive, infringing or in any way objectionable to ePrice.

6. Rights ePrice Reserves

ePrice has no obligation to support the API.

API is currently available free of charge, but it is entirely in ePrice’s discretion to charge a fee for it in the future.

Nothing prevents ePrice from independently developing something similar to your Application.

7. Term and Termination

These Terms will apply when you start using the API. You may terminate these Terms by discontinuing use of the API.

It is entirely in ePrice’s discretion to provide you with support or modifications for the API or stop providing you with support or modifications for the API at any time without notice or liability to you.

ePrice may modify or terminate these Terms or limit your access to all or any part of the API or its features at any time for any reason. ePrice may also publish subsequent versions of API and require that you use them. If ePrice changes any part of the API or any part of these Terms, your continued use indicates that you accept the changes.

All of ePrice’s rights in these Terms may be exercised without prior notice or liability to you.

Immediately upon termination of these Terms, all licenses granted to you will cease and all the Content and other data in your possession or control pursuant to your use of the API must be deleted unless ePrice agrees otherwise in writing. You must also promptly destroy any ePrice confidential information that you may possess or control.

8. Limitation of Liability

ePrice provides the API and all other information and services “as is” with no warranties of any kind concerning them. ePrice is not responsible for any errors in the API or for any damage or inconvenience caused to you or the End user by these API terms of use, use of API or Content.

ePrice does not guarantee that API functions without interruptions or errors. ePrice is not liable for any malfunctioning or poor use conditions of the API due to inappropriate equipment, disturbances in communications or for any other similar reason.

You warrant and indemnify ePrice against any alleged claims that you have the right to use, reproduce, transmit, copy, publicly display, publicly perform, and distribute your Application, and that use of your Application will not violate the rights of any third party, or any regulation or law.

You accept that ePrice has no liability towards you, your End users or any third party for any kind of damages resulting from the use of your Application, your use of the API or from your breach of these Terms. You agree to indemnify ePrice against any claims from your End users or from any third party resulting from use of your Application, your use of API or from your breach of these Terms.

You are responsible for all costs that result from your use of the API.

This section will survive any termination of these Terms.

9. Dispute Resolution

These terms are subject to the laws of Finland without regard to conflict of law principles.

Disputes regarding these Terms or the rights and obligations of the parties under these Terms that cannot be solved first by the parties’ amicable negotiations will be resolved at Helsinki District Court.

You may not assign any rights or obligations under these Terms. ePrice may freely assign all or some its rights and obligations under these Terms without prior notice to you.

This section will survive any termination of these Terms.
